ERISA erases benefits

This is absolutely sickening.

"Federal appeals courts, interpreting Supreme Court decisions dating to 1993, consistently have said companies that offer health, life and retirement benefits under ERISA cannot be sued for large amounts of money, or damages. Instead, they can be sued only for typically smaller sums such as Amschwand's insurance premiums...Several federal judges have bemoaned the unfairness even as they have felt constrained to rule in favor of employers...."

yes, and no body of government seems willing to do anything about it

judges and even bushco bemoan the problem, but only congress can actually do anything about it

TSCOTUSA has sustained the lower courts

i.e., you can pay but if there is any loophole, the company can just refund your premiums and not pay what you were insured for to your beneficiary AND YOU CANNOT SUE
 
The SCOTUS these days are kind of pitiful. Used to be there were at least two members who'd never turn down crit. These days they're lazy as hell and hardly ever pick up any cases. I have no idea in hell how they wouldn't want to fix this once and for all, but it does give them more off time.

And then the Pelosi lead Republican congress does shit about it, of course.

thats crazy. im waiting for the day that we get to the point where enough people in this country say FUCK YOU and just stop paying taxes. They cant take us all on.
