it goes with the old 'there ought to be a law' bullshit. someone commits a heinous act with a weapon that ISN'T outlawed, so people join a bandwagon calling THAT weapon a 'weapon of war' or some other such bullshit and off we go. especially in NY, where they hate guns almost as much as Illinois does.
