Just a point of clarification SCOTUS means Supreme Court of the United States. SO there is no state SCOTUS. Just a state Supreme Court. That being said, the justice should have excused himself from the case. I have had Judges recuse themselves from my case because we were close friends prior to her becoming a judge. This is a no brainer. you don't only avoid impropriety you avoid the appearence of impropriety
