Since the Bill of Rights was established, the Constitution has been amended 17 times. One of these times was when the Twenty-Second Amendment was passed in 1947 which infringes upon our right to elect the President of our choice.
If we pause, if we take time to reflect, if we wait to see how well our President does, we will, in all likelihood, lose the option of electing him in 2016. The END22.com movement is not about making sure President Obama is re-elected in 2016 - it is about making sure the people have the right to make the best choice in 2016. If we believe it is our current President, we should have the option of voting for him. If we believe it is someone else, we will do as we have done so often in our history, and elect someone else to the office.
When congress passed the Twenty-Second Amendment in 1947, they restricted our right to elect the President of our choice, but continued to allow themselves to be elected and re-elected with no limitations. It has been noted that Presidents Ronald Reagan, Bill Clinton and Dwight Eisenhower have all been critical of the Twenty-Second Amendment.
As was noted in this op-ed piece in the New York Times from January 5, 2006: "There was nothing in the original Constitution of 1787 that barred a third or fourth term for presidents. That was why Franklin Delano Roosevelt could run again in 1940 and 1944, becoming the only president to serve more than two terms. And that was why, three years later, in 1947, after sporadic public debate, Republicans demanded presidential term limits and changed the Constitution. ... "We ought to take a serious look and see if we haven't interfered with the democratic rights of the people," Ronald Reagan said in 1986." the article further states: "... they .. can hope that in another world crisis, this misbegotten amendment will not be there to bar a future Franklin Roosevelt from offering the kind of leadership that he provided in the 1940's." Technically, an Amendment to the United States Constitution isn't removed, rather it is invalidated by a subsequent amendment.
First, two-thirds of both houses of Congress must vote for the amendment. Three-fourths of the states (38 states) must then ratify the legislation. This means we must first focus our efforts on congress, and then move our attention to the states. To do this we need time. It is urgent that we act now!
As an example of the repeal process, the Eighteenth Amendment to the constitution established "Prohibition", making it legally difficult to obtain alcohol. The 18th Amendment was repealed by the Twenty-First Amendment.
Text of the Twenty-First Amendment:
Section 1. The eighteenth article of amendment to the Constitution of the United States is hereby repealed.
Section 2. The transportation or importation into any State, Territory, or possession of the United States for delivery or use therein of intoxicating liquors, in violation of the laws thereof, is hereby prohibited.
Section 3. This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by conventions in the several States, as provided in the Constitution, within seven years from the date of the submission hereof to the States by the Congress.
The Amendment Process:
Article. V. of the US Constitution
The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.
