Here is an article outlining past cases and why some are prosecuted and some aren't, but mostly because the laws in the past were not clear on the subject matter and it was also a matter of intent.

did something turn out false?.....she lied about the cause of Benghazi, she lied about her emails......the Obama appointee says we shouldn't prosecute......that doesn't make anything false about the scandals.....

Saying he didn't believe he had enough evidence to prosecute does not mean she did not break the law.

so if I go to trial in florida because I open carried a long gun, but was under the impression that long gun open carry was legal because I'm from TX, you'd acquit me?

If I accidentally send the plans to make an atom bomb to Iran, I should not be prosecuted?

If my car accidentally rolls down the street all by itself, and runs over a child, I should not be prosecuted ?

Is that about right ? I had no INTENTION to do any of the above....
