IMO, this is simply to force the SCOTUS to rule on the Amendment, whether Jurisdiction in the Amendment means political jurisdiction or legal definition (according to the OP)... Or he's going to do it some tricky and convoluted way, if he does it at all.

The Supreme Court does not have authority to change or interpret the Constitution. See Article III of the Constitution of the United States.

It did not exclude the native American. All people who are born in America is a native American. It is time to drop this PC term for the various American Indian nations and tribes.

The 14th amendment does exclude the American indian from being a citizen of the United States. Their jurisdiction is to their tribe, not to the United States. The 'reservation' system used today is the result of Pres. Jackson's theft of their land and the murder of anyone capable of defending the tribe, then forcing the old, the women, and the sick, to march hundreds of miles to a 'reservation'. Jackson later made a tidy sum selling the stolen land to settlers. Read up on the 'Trail of Tears'.

Today, due to various treaties that exist between the tribes and the government of the United States, many tribes are also considered United States political jurisdiction, and they can participate in national elections. This is due to treaty, not due to the 14th amendment.
