When Trump called on his thousands to "attend" the Senate proceeding and keep on eye on Mike Pence he surely knew that could only occur by first breaking into the locked and guarded Capitol building. He didn't dare be an active part of it himself so after he lied by saying, "I will join you", he quietly had his Secret Service escorts take him to the WH. There is clear cause for his arrest if DOJ has the balls to do it.

What "mind reading" is needed - that Trump knew the Capitol was closed? Yes, Trump is largely ignorant but he wasn't alone. If he can establish that none of the aides, or Secret Service or others who joined him in running the rally ever pointed out the invasion of the Capitol on which the purpose of the march was focused would require overcoming the guards and breaking into the building then he has a defense. Let him make it.
