Judge Linn set a Jan. 27 hearing for motions prior to sentencing.

With no prior criminal record it's likely he will receive a light sentence. I'll be surprised if he gets any jail time at all. Fine and probation is my best guess.

On Twitter, he said the “the despicable act of racism and hatred leaves me incredibly saddened and serves as a painful reminder of how much further we have to go as a society and how persistent we must be in the fight against racism.”

The two men -- both white and wearing ski masks -- viciously attacked Smollett as he fought back, but they beat him badly and fractured a rib. They put a rope around his neck, poured bleach on him and as they left they yelled, "This is MAGA country."

Smollett was taken to Northwestern Memorial where he was treated. He was discharged later Tuesday morning.

Chicago Police spokesman Anthony Guglielmi released this statement about the attack: "Overnight, the Chicago Police Department received a report of a possible racially-charged assault and battery involving a cast member of the television show Empire. Given the severity of the allegations, we are taking this investigation very seriously and treating it as a possible hate crime. Detectives are currently working to gather video, identify potential witnesses and establish an investigative timeline. T
