Trial Docs: Sussmann Edited FBI Press Release About DNC Hack Because It ‘Undermined’

Documents released during Michael Sussmann’s federal trial show the FBI solicited advice from Hillary Clinton’s lawyer on a press release describing the intelligence agency’s awareness of the Democratic National Committee hack in 2016.

The original press release sent over to Sussmann by Jim Trainor, the assistant director of the FBI’s Cyber Division, noted that the FBI was aware of “a possible cyber intrusion involving the DCCC,” or the Democratic National Campaign Committee, via “recent media reporting.”


“Michael – our press office is once again getting a ton of calls on the DCCC matter. A draft response is provided below. Wanted to get your thoughts on this prior to sending out,” Trainor wrote.

In his reply, Sussmann asked the FBI to change the first line of the press release to reflect the DNC’s messaging on the hack. He explained that he preferred a more definitive statement that made clear “the FBI is aware of the cyber intrusion involving the DCCC that has been reported in the media.”

“The draft you sent says only that the FBI is aware of media reports; it does not say that the FBI is aware of the intrusion that the DCCC reported. Indeed, it refers only to a ‘possible’ cyber intrusion and in that way undermines what the DCCC said in its statement (or at least calls into question what the DCCC said),” Sussman wrote. “The other implication in your statement that could benefit from updating is that the FBI, just now, is looking into the nature and scope of the DCCC matter. In fact, the FBI has been aware of the DCCC intrusion for some time, and even (previously) received network indicators from the DCCC (i.e., from CrowdStrike).”

Trainor accepted the suggestions with minor protest and agreed to send out Sussmann’s manipulated version of the press release soon.

So, without going into the absurdity of the whole Durham charade, what’s your point, that the FBI asked the Clinton lawyer to comment on a press release they had prepared regarding their awareness of the campaign being hacked?

the fbi should not be consulting with political campaigns about investigations regarding their opponents.

Why? I get the sense that AssHatZombie perceives something problematic here, but I don't see what. The story is pretty simple: a crime was committed against the DNC. The FBI was doing a press release about it and ran it by the victim's lawyer. The press release they proposed referred only to being aware of the media reports about the crime, when in fact they were aware of the crime itself. So, the victim's lawyer suggested they say as much, and they did. So what?

OMG... the Horror. The FBI said they were aware of the cyber attack they were investigating rather than just saying they were aware of the media reports of the cyber attack that they were investigating.
Quick. We need to shoot everyone involved for telling the truth.

No, I don't agree, in a case like this, where the political group in question was the victim of a crime and the press release is about the crime.

If I were the victim of a crime and the FBI was going to do a press release about it, I'd like to think they'd run it by my lawyer to get that perspective on how it should be worded. And if they'd made some error, like merely saying they were aware of media reports about the crime, when they were actually aware of the crime itself, I'd like to think they'd fix that error when it was pointed out to them.

How about you: do you think the FBI should avoid giving victims of crimes the chance to comment on press releases about those crimes before they go out?
