Marriage is the only one of your examples that the U. S. Constitution applies. Housing is based on federal housing legislation based on the regulation of interstate commerce. The buying cake thing is not protected by the Constitution or federal civil rights laws but various state and local legislation. Those laws contain factors such as the number of employees in the bakery, whether decorating a cake involves a "creative" activity, etc.

In the Masterpiece Cakeshop case the Supreme Court ruled in favor of the bakery.

Rightfully so. Otherwise you could have someone showing up at a Jewish owned bakery demanding a cake be made with a swastika on it for their rally.

First, I doubt a Nazi would go to a Jewish bakery, but if he came to my bakery, I’d bake his cake, but tell them the customization would be $500. If they still wanted the cake, I’d bake it smiling that I made a hefty profit.

That would be one way of handling it. Others may be more principled though and not care about the profit.

It was a very narrow decision based on comments made by civil rights commissioner comments showing prejudice toward the bakery shop owners religious views. It ruled the hearing was unfair and did not really rule on the bigger issue of whether the owner's religious beliefs outweighed the anti-discrimination law.

In a few cases the law did not apply to similar businesses because they did not have enough employees to qualify.

I'm not sure why a Jewish owned bakery would be exempt for refusing to make a cake with a swastika even though I'm sure some of our JPP posters would see a difference.

At least one of them would, yes. But why should we sit idly by and spend years in uncertainty as courts decide the issue (again)? There is Supreme Court precedent and now a federal law. That's a lot harder to undo than simply one or the other.

I understand the technicality. I just don't think it matters because as you said, not a lot of straight people of the same gender are getting married to each other.

Agreed. There have been a few cases of "sham" marriages (gay or straight) by people seeking health benefits for friends.

Precisely. There are myriad ways to deny service to a customer without claiming religious persecution.

I turn down jobs all the time because I simply don't have the time. If they want to wait, they wait.
