Nope. That defense doesn't hold water. A claim of vindictive prosecution requires an absence of a crime. The evidence for the crime has already been deem admissible, and then there's a Grand Jury indictment which seals the deal. Comey is going down hard.
That won't be an issue before the court. Only the crime being prosecuted will be before the court, not some appointment process that does not involve the court. The court will ask if the prosecutor is in good standing with the bar and that will be the end of that.
Because the Comey case is open-&-shut, they'll likely be done before lunch.

Experienced prosecutors refused to take the case. It has no legs. Trump used an unqualified and inexperienced lawyer to do the deed. That should tell you something. It is Trump's pressure that got the case going. He will settle for Comey being publicly humiliated, even if a few million tax dollars are wasted.

What it looks like it is based on is the Ted Cruz Congress analysis of a lie which has already been shown to be stupid and wrong.

To answer your question, Id have to see the transcripts. From what I have seen, there is an early statement, then a later one where he says something about reaffirming something about his earlier testimony. I have not seen the earlier transcript or the later one, so I do not know if the charge against him is valid or not.
I do believe it is unlikely to result in a conviction, because of the convoluted reaffirmation of a prior convoluted statement, but who knows what a jury will do, if it gets that far.
They have to prove intent to lie to congress, and with all the words in there, it gets very confusing, even to the reader, what Comey was affirming and not affirming. Not a case I would take if I were still a prosecutor.
