however, if this little trick of gaveling in and out every 7 seconds or so is supposed to show that congress/senate is not in a recess, then fuck the republicans. this little stunt will not and should not work.

No, but Senate practice dictates what defines a recess or are you going to pretend that isn't the case? If this isn't rejected by the courts, then the President can simply appoint whomever he/she chooses anytime they want by simply declaring a recess has occurred. Tell us oh glorious hack... do you think the President should be able to tell Congress when they are recessed? Does this mean every weekend the President can appoint whomever he/she wishes?
The Senate is in recess. The President has the power to recess appoint while the Senate is in recess. There is no three day requirement as you initially suggested.

The Senate is in recess. It just cannot adjourn for more than three days because the House is not in recess. So every three days the Senate hold a pro forma session and then goes back on recess for three more days.
