So we have a US born American citizen being held without trial. Everyone knows he is not an illegal alien, but illegal aliens do not have the right to question whether they are an illegal alien, so he cannot get free, even though he is not an illegal alien.

A US born American citizen cannot get out of prison, even though he is found to be a US citizen, because illegal aliens have no rights, even though they are not illegal aliens... That is the system not working.

If he had been released, that would be the legal system working in the end. What is happening now is that he has no access to the legal system, because he is being held as an illegal alien, so he is not allowed to prove he is not an illegal alien.

In normal times, it would be. The judge would see that he is a US citizen, and order his release. If he was kept in custody, it would be false imprisonment.

The problem is that trump is claiming that illegal aliens do not have the right to prove they are not illegal aliens... Which means that legal aliens, and now even US citizens are being swept up, and not released.

If they deport him to El Salvador, it will be a whole new level of hell. The trump administration will then be able to claim that they cannot get him back, while they pay El Salvador to hold him.

I see a whole lot of lawsuits coming toward the Trump administration....and Trump will throw the flunkies under the bus while walking away clean.

The right of habeas corpus is not a right to be released, but rather a right to argue that you should be released. There were some accused terrorists who were able to argue they should be released, but many who were not able to.

This US citizen is being told that even though he can prove he is a US citizen, he does not have the right to prove it, because he is an illegal alien... Even though he is not an illegal alien.
