I do think Trump will get nailed on a couple of things depending on how they argue it in court but most of the 78 charges against him aren't going to stick.

I just don't have the information to determine it at this point.

Not until the trials start.

I think his biggest problem are the documents and the obstruction charges.

The conspiracy stuff is just stupid.

But then again, that's arguable also. The documents weren't hidden so nothing actually happened there. The big question is whether or not Trump had the right to them in the first place, that will definitely go to the Supreme Court.

And he still hasn't admitted it to this day so the evidence he didn't believe it is overwhelming thereby sinking Smith's entire conspiracy case.

That's why these particular charges were never going to work in the first place and it doesn't matter who told Trump what, it matters what he believed.

There are really only two issues Smith can get Trump on.

One is taking documents from the WH when he left but he isn't charged with that because then Smith would also have to charge Biden.

The second is trying to cover up the video tapes after the subpoena was issued and that relies on the testimony of one witness who himself is also being charged. And this witness would need actual proof of Trump telling him to do it otherwise it's Trumps word against his.

There is nothing in these 78 charges that are going to stick.
