What police say happened on North Prospect Street

While walking on Prospect Street Saturday, the three men were "confronted by a white male with a handgun," police said.

"The suspect was on foot in the area. Without speaking, he discharged at least four rounds from the pistol and is believed to have fled on foot," police said.

Two of the victims were wearing keffiyehs, traditional Palestinian scarves, at the time of the assault, according to police. The victims were transported to the University of Vermont Medical Center.

19th century America, Jews were generally believed to be a distinct race within a broad category of white people. Jews who wanted to maintain their distinct traditions self-described as both racially Jewish and white. This was a common way of viewing race at the time; immigrant groups like the Germans, the Irish, and Jews were seen as distinct races, but they could still all be seen as white

It is early days with that prosecution, so it is anyone's guess.

But it is a weak case. Alnaji was at a pro-Palestinian protest, when Kessler showed up to a counter protest. Kessler ran past police lines, and confronted Alnaji. Both parties pushed each other, Kessler fell over backwards and died.

First, it is hard to make murder out of that. There is no reason to believe pushing someone will kill them. Second, Kessler crossed the police lines to confront Alnaji. I would like to know who pushed first, but both men were using similar levels of aggression. It is not like Alnaji picked out Kessler to take away his rights, so hate crime would be a near impossible sell. Involuntary manslaughter is still on the table, because Alnaji should not be shoving people, and it had a very poor outcome this time. In another state, even that might not be a crime. In Texas, Alnaji could have shot Kessler, and claimed the shoving as something worthy of lethal self defense.

Hate crime prosecutions have not be chosen in the Vermont case either, but they are probably a better fit. The murderer premeditated an intentionally lethal attack on Muslims, because they were Muslims. There was no interaction other than that.
