Ohio company owner gets 25 years in fraud case

CINCINNATI (AP) - A business owner convicted of defrauding customers seeking male sexual enhancement products and a variety of herbal supplements was sentenced Wednesday to 25 years in prison.

Steve Warshak, 42, founder of Berkeley Premium Nutraceuticals, also was ordered to pay $93,000 in fines. He was convicted in February on 93 counts of conspiracy, fraud and money laundering.

Federal prosecutors accused the company of bilking customers out of $100 million through a series of deceptive ads, manipulated credit card transactions and refusal to accept returns or cancel orders.

U.S. District Judge S. Arthur Spiegel ordered the company, along with other defendants, to forfeit more than $500 million. He said it was impossible to calculate exactly how much money was lost by customers, so he accepted a figure based on how much Warshak and the company took in.

Berkeley distributes various products alleged to boost energy, manage weight, reduce memory loss and aid sleep. The company's main product, Enzyte, which promises sexual enhancement, has ads featuring "Smiling Bob," a happy man with an exaggerated smile.

"This is a case about greed," Spiegel said as he reviewed the case. "Steven Warshak preyed on perceived sexual inadequacies of customers."

Spiegel said one aspect of the fraud relied on the reluctance of customers to come forward, which would mean admitting they ordered the sexual enhancement pills.

And who the hell didn't know this Enzyte stuff was a scam? What was its main ingredient, vitamin A? That's how a lot of herbal supplements work.
 
And how would you know it's main ingredient was vitamin A, and how that type of supplement works ? Heck I don't even know how the prescription stuff works.

the prescription ad did drop the part about a 4 hour woody though for some reason.
 
Bob was funny. But I laughed out loud at the look on Mrs. Bob's face. Now THAT was a good commercial.


The guy made a fortune preying on the feelings of inadequacy in men. And the funniest part is that most of those men were probably doing fine.

I don't. I was mocking how a lot of herbal supplements claim huge effects and have useless ingredients. The market for herbal supplements, in case you've been living under a rock, is completely unregulated, which is the only reason an herbal supplement that has useless ingredients and claims to do things like make your dick bigger even exists.

Enzyte wasn't a perscription. I'm pretty sure Viagra still does have those warnings, because if you get an erection for more than four hours and don't do anything about it they'll have to chop it off.

Yeah, a lot of people down here eat them. It's not scientifically proven or anything. But then again, no one would probably ever want to do a test on it. The people who make Viagra, for instance, can't very well patent shellfishes, and if they knew shellfishes made you hard they'd have ever reason in the world to suppress the information.
 
Oysters are supposed to "put lead in your pencil" according to the old wives tales. (I wonder if the old wives smiled like Mrs. Bob)

But science says they don't do anything.

Being healthy is the best way to make sure the equipment works later in life.
