both the governor and the attorney general of california oppose the ban on gay marriage
since most of the money to get the ban passed came from out of state, the duly elected officials of california have refused to support the ban in court
not the california supreme court gets to rule on whether or not those same out of state interests (and in state interests) can fight the court ruling declaring the ban on gay marriage to be illegal
