The concept is not new. Almost every election the losing party talks about it. Nobody has been that nefarious. Trump is.

You posted the constitutional provisions that give the states that power. Most state laws say the electoral slate goes to the candidate receiving a plurality of popular votes, but there is nothing saying the legislature can't change that and select electors directly unless it is in the state constitution.

I don't favor such an action, just saying the state legislature has that power.

There is nothing in the Constitution that gives the States the power to overrule the vote of the people.

The Constitution makes no mention or provision about the vote of the people. It gives the states the power to select electors and over time the states passed that power to the voters through state laws/constitution. They have the power to change that method (if they want to commit political suicide).

Yes but ... Pennsylvania law says the voters elect the electors. They can’t retroactively change the law. Would never be allowed. And of course it would be political suicide. Dumb idea from Trumps idiot son.

I agree it is extremely unlikely. However, it would not have to be retroactively because the electors do not meet until Dec. It would be a future action. It would also be political suicide for the legislators choosing to do that.

They would be choosing the electors for the December meeting. I agree there are many obstacles, just saying the legislature has that power.

The Trump people would have more luck trying to lobby the electors to vote for their guy. About 7 electors in 2016 did not vote for the popular vote winner in their state.

It would because electors are chosen by the election which has already taken place. No court would allow it.
