Fox News contributor Andrew McCarthy told Fox & Friends this morning that he believes President Donald Trump will be indicted on campaign finance charges in Manhattan Federal Court.

On Sunday, McCarthy, a former federal prosecutor, told Fox & Friends Weekend host Pete Hegseth that New York prosecutors are “clearly going after the president on campaign finance violations.”

“[In] the Southern District of New York case, which is different from the Mueller case, they are clearly going after the president on campaign finance violations and if you read the sentencing memo the Southern District filed in Cohen’s case, it’s clear that Trump is the target and he’ll be indicted eventually,” McCarthy said, before Fox News host Ed Henry responded: “That kind of stops me in my tracks."

Campaign finance violation, felony guilty plea, conviction, and pardon

On May 15, 2014, United States District Judge Richard M. Berman rejected the contention that D'Souza was singled out for prosecution, stating, "The court concludes the defendant has respectfully submitted no evidence he was selectively prosecuted."[SUP][150]

On May 31, 2018, President Donald Trump granted D'Souza a full pardon, claiming on Twitter that D'Souza "was treated very unfairly by our government."[SUP][17][/SUP] In a tweet that same day, D'Souza noted that Trump had not only pardoned him but had (earlier) fired Preet Bharara, the U.S. attorney who prosecuted him. According to D'Souza, U.S. Senator Ted Cruz made a personal plea to the president to pardon him, and other members of the president's "inner circle" had also lobbied for a pardon.[SUP][153][/SUP] However, President Trump stated to journalists on Air Force One that "[n]obody asked [him] to do it."[SUP][154][/SUP][SUP][155]
