He does have an escape route, declare a national emergency fully knowing it will be tied up in the Courts endlessly, and pass something similar to last December's Senate bill

He can appease the radio gods with the emergency declaration while quiet the Democrats with a budget including their border concerns while boasting himself the "great deal maker". The only ones pissed of significance will be the GOP Senators, but I'm the end, he owns them, and they'll live with it
