When Democrats wail that it's "not a crime" to enter this country illegally, they're wrong.
  • Illegal entry (crossing the border without inspection/admission): 8 U.S.C. § 1325 – a federal misdemeanor for the first offense (up to 6 months in prison and/or fine), and a felony for any subsequent offense (up to 2 years).
  • Illegal re-entry after deportation:
    8 U.S.C. § 1326 – a felony
Simply being in the country without lawful status (like visa overstays) is a civil violation, but entering without authorization is always a crime, and staying here can become criminal too.
  • Final Order of Removal issued by an immigration judge and the government has formally told you in writing exactly when and where to show up to be deported
    → If you willfully refuse to show up for that deportation, it’s a federal felony under 8 U.S.C. § 1253(a)(1)(B) – up to 4 years in prison (10 years if you have certain criminal convictions, 20 years if you were removed for an aggravated felony).
  • Expedited Removal Order signed by a CBP or ICE officer at the border or port of entry → Once that officer hands you the order and tells you “you are prohibited from entering the U.S. for 5 years” (or permanently if it’s a second illegal entry), if you come back before that ban expires, it’s automatically the felony of illegal re-entry under 8 U.S.C. § 1326 – up to 2/10/20 years depending on your criminal history.
Even under braindead's inept regime in FY 2024 (which ended Sept. 30 and overlapped with the current administration), over 85% of all federal criminal prosecutions in many border districts were for these immigration offenses (1325 and 1326).

When Democrats sob that an illegal criminal didn't commit any serious crimes in America, they're also wrong, in many cases.

What low-information Democrats don't know (because nobody is telling them, apparently), is that some illegal immigrants who don’t have criminal history in the US fled here to escape justice in their own country.

He was just arrested by @ICEgov and is wanted for murder - not here, in El Salvador.

He was on El Salvador’s "most wanted gang members" list.

While technically his only crime in the United States (besides illegal entry) was driving without a license, this illegal alien was wanted in El Salvador for aggravated homicide, extortion, possession of drugs, and a litany of other felonies.

70% of the illegal aliens arrested by Department of Homeland Security (DHS) law enforcement have been charged or convicted of a crime in the US, but this statistic doesn’t even count gang members, terrorists, human rights abusers, and foreign fugitives who lack a rap sheet in the US.

I doubt any Democrat will ever consider cases like these when CNN or MSNBC breathlessly reports that illegal immigrant X didn't do nothin', but that very incuriosity is why they're Democrats, I suppose.
 
A criminal illegal alien from Mexico has been arrested in relation to Saturday’s shooting targeting Border Patrol agents in Chicago.

The suspect has a previously been convicted for aggravated unlawful use of a weapon/vehicle, felony possession of a weapon, and illegal entry.He is currently marked as a violator of the Laken Riley Act, pending charges.

This incident is not isolated and reflects a growing and dangerous trend of violence and obstruction.

Over the past two months, people who don't rely on "trusted news sources" spoon-feeding them false information and lies-by-omission have seen an increase in assaults and obstruction targeting federal law enforcement during operations.

These confrontations highlight the dangers our agents face daily and the escalating aggression toward law enforcement.
