Well, it didn't work for me.

The article mentions further down he's in some facility in Louisiana now. Regardless, the rest of the article largely ignores that he's a foreign national, and that means he has restricted rights compared to a US citizen. He's going to have a hard time proving to a court he wasn't engaged in protests the government finds objectional on a number of grounds, and his participation alone is sufficient to allow a legal deportation.
