NH House votes to kill death penalty

CONCORD – The New Hampshire House has voted to repeal the state’s death penalty laws by a vote of 193-174.

House Bill 556 will now move to the Senate. The House earlier Wednesday passed HB 520, calling for an in-depth study of the state’s death penalty laws.

Both bills now move to the Senate.

Gov. John Lynch opposes the repeal and promised to veto it.

“I do believe there are some crimes so heinous that capital punishment is warranted, and if a bill to repeal capital punishment reaches my desk I will veto that bill,” he said minutes after the House action.

The Legislature passed a repeal of the death penalty in 2000, but Gov. Jeanne Shaheen vetoed that bill. An attempt to override her veto failed by 34 votes.

Death penalty opponents said that as long as the statute is on the books, the state runs the risk of executing an innocent person. The use of DNA evidence has increased the rate at which death row inmates are found innocent and released, they argued.

Those who urged that the state keeps its capital punishment laws on the books said the state applies in limited cases. They said it provides an added layer of protection for law enforcement who put their lives at risk.

State law reserves the death penalty for those aged 18 and older who kill police and corrections officers who acting in the line of duty, judges, victims of rape and kidnapping, during drug-related murders and murder-for-hire.

The state has not executed a killer since 1939. In December, a Hillsborough County Superior Court jury convicted and sentenced to death Michael Addison for the 2006 murder of Manchester Police Officer Michael Briggs.

Rep. Jackie Cali-Pitts, D-Portsmouth, who voted for the repeal, said she’s not declaring victory yet.

“This has happened before. This is déjà vu. Now it’s a matter of what happens when it gets to the Senate, and how the governor feels when it gets to his desk.”

Deputy Republican Leader Rep. David Hess, R-Hooksett, called the vote “a direct affront to every law enforcement officer who puts his life on the line.” He said it puts corrections officers at particular risk because inmates already serving life sentences won’t have to fear any greater punishment.
