Chicago police officer says she feared using gun while being beaten

A Chicago police officer who is hospitalized after she was severely beaten said she was afraid to use her gun because of the scrutiny she would have faced, Supt. Eddie Johnson said.

On Wednesday morning, police responded to a car crash at Roosevelt and Cicero on the city's West Side where officers encountered a man that police allege was violent and under the influence of drugs.

Three officers were hospitalized in the incident. One officer who was severely beaten told Supt. Johnson she was afraid for her life and afraid to use lethal force with all of the attention on the police department's previous actions and fatal incidents.

"She thought she was going to die. She knew that she should shoot this guy, but she chose not to, because she didn't want her family or the department to have to go through the scrutiny the next day on national news," Supt. Johnson said.

A nearby business captured surveillance video of the incident. The owner didn't see the incident firsthand, but saw how the incident unfolded on the surveillance video.

"It is terrible. It is total disregard for law enforcement. They put their lives forward every day for us and to see somebody do this, to pummel the police officer is terrible. It is a terrible thing," business owner Louie Rainone said.

Teen suspect in deputy’s killing in adult jail

Austin Holzer, who turned 18 on Monday, is now housed in the Montrose County Jail while he awaits hearings in Mesa County District Court in connection with the killing of Mesa County Sheriff’s Deputy Derek Geer in February.

Holzer had been held in a juvenile facility, the Grand Mesa Youth Services Center, since his Feb. 8 arrest, the same day authorities say he shot Geer, who was answering a call about an armed man in a neighborhood.
Geer died two days later.

A hearing is scheduled in October on motions by Holzer’s public defenders, who want him returned to the jurisdiction of juvenile court.

How Holzer will be transported to and from Mesa County for court appearances will be determined as those hearings approach, said Henry Stoffel, spokesman for the Mesa County Sheriff’s Office.

Holzer is not being housed in the Mesa County Jail as he would come into contact with Geer’s friends and coworkers.
“Montrose County recognizes that this is a very difficult situation, they have agreed to house Mr. Holzer and have not asked for any compensation,” Stoffel said.

Holzer is charged with first-degree murder in the shooting of Geer, which occurred after a scuffle in which Geer never pulled his handgun.
Conviction in the case would result in a life sentence with no possibility of parole.

Holzer is seeking to have the case returned to juvenile court, where he could be held only until his 21st birthday.
The defense also wants to question whether the case against him is so overwhelming that he should be denied bond.

In a similar vein, Holzer’s defense also wants a preliminary hearing during the three days of hearings in October before Mesa County District Judge Richard Gurley.
