Judge Maxwell Wiley has dismissed the top charge of second-degree manslaughter against Daniel Penny in the death of Jordan Neely at the request of prosecutors after considering declaring a mistrial after jurors reported they continue to be deadlocked on the charge.

He said he will encourage the jury to continue deliberating on Monday the lesser charge of whether Penny committed criminally negligent homicide in the death of Neely, a homeless man, on the New York City subway last year.

Convict this guy and you can kiss the good samaritan goodbye.

Nobody will want to help anyone out anymore out of fear of being prosecuted should something go wrong.

I have ridden the NYC subway system since I was 11 In 1961, there were a few times when I saw a mentally ill person lasing out verbally. People just moved to another car and at the next stop got the transit police

Attacks in NYC transit jump a massive 50% as subway murders surge

Assaults on NYC subway hit 27-year high in 2023

And the nut was threatening people on the subway in 2023 not 1965
