NYPD: 9 shooting bystander victims hit by police gunfire

Security camera footage showed the officers had only an instant to react when Johnson suddenly turned as they approached and pointed his gun at them, his arm cocked as if to fire.

Their encounter was over in eight seconds. The officers, who had been standing nearly close enough to shake hands with Johnson and had no opportunity to take cover, fired almost immediately.

if they are, these guys weren't. what is your opinion of the take down? they were close, granted little time and some shots ricocheted, but to hit 9 bystanders....be interesting to here from someone who has law enforcement experience or military.

IMO, it just goes to show that police officers are not trained well in firearms, nor any sort of combat tactics. It's an unfortunate tendency that happens when a small segment of society (police officers) are given near total immunity for any acts of negligence or injuries caused because they are enforcing the will of the government. Because they have this immunity, they worry alot more about their own safety and that of their fellow cops, and way less about the safety of those around them.

If they had been trained better, they wouldn't have panicked and fired 16 shots, hitting 9 bystanders. They would have fired 2 rounds each, at most 3, and hit their intended target with all of them and way more control.

i totally agree. the whole immunity thing, while well intended, has become a draconian police state tactic.

it especially sucks in that the qualified/absolute immunity doctrine relieves it's employees of any liability for their actions, unless said actions violate a clearly established law, and holds the city liable for their failure to train their police on the law. Private employees don't get that kind of protection, leaving them open to all kinds of liability.

i actually knew someone that had a case along these lines...and iirc....it also determines policy, not just law. in that, did the officers follow police procedures and policies.

it is very hard to overcome and takes YEARS in court to fight, most of time, unless you have a prominent case the police want to bury.

it's especially infuriating that ignorance of the law is no excuse for us, but cops are not required to know all the laws unless the city has trained them on it.

good point. i will point out though....it really isn't the law....rather the standards, techniques etc....if they broke the law....different story. that is why QI is so effed up.

not so. case in point.....the guy arrested for open carrying in to a theater. the cops flat out said afterwards that he was indeed within the law and that they were wrong because they were working under a outdated 'cheat sheet', so they unlawfully arrested someone but those cops will not suffer any consequences, just the taxpayers.

ok...fair enough... i was talking about physical injuries.

the difference is...the police there, were operating within their given guidelines. thus, why should they be personally responsible for what their employer tells them to do?

physical injuries becomes iffy. it becomes a question of excessive force or not. guidelines are great, but leaving the standard of reasonable up to judges is always a bit late for the person who is now paralyzed or dead.

I'm not sure what film you saw; but the one you linked to showed the closest officer about 8 feet away and yet, you say they were nearly close enough to shake hands.

What would you have done and when's the last time you had to exchange gunfire with someone who was pointing a weapon at you?

good point. the article obviously used hyperbole. i don't know what i would have done, that is why i wondered about those in law enforcement or military.....common sense, to me, seems that you would not shoot NINE bystanders. what i would have done is wholly different than what a supposed police force is TRAINED to do.

you're in corrections right? what would you have done?

Why don't you try this.
You and a friend of your choice go down and practice with some paint ball guns, until you feel your proficient.
You can't load them anymore then a regualar Police weapon holds.

Once you feel your proficient, gather up around 24 friends.
One of them gets to be the "shooter" but he gets to wear protective gear.
The other 23 get to be "pedestrians" and they also get to wear protective gear.
Now you and your friend have to have your weapons holstered, you have to run up on the shooter, and when he turns and points his weapon at you, you then get to draw and fire back.\
By the way, you and your friend don't get to wear protective gear.

After you and your friend have fired a total of 14 shots, I want you to count how many hit the "shooter", how many hit a "pedestrian" and how many missed everything.

I bet you anything that you don't hit the "shooter".

why didn't you answer my question? i answered yours?

you claim to be a juvi correctional officer....yet you wuss out.

why is that? why is it you can't say what YOU would do?

I'm not one of the ones casting aspirtions on what was done, so instead of bitching and moaning; show what you're made of, seeing as how you seem to have found fault with the situation and nothing positive.

Where did you get the idea that Juvenile Corrections Officers are permitted to wear sidearms, while on duty, and the idea that they are involved in the arrest of criminals?

Do I like the fact that 9 other people were shot? - NO; but it wasn't like the Police had the time to say "TIME OUT, THERE ARE PEOPLE PRESENT".
You also seem to be forgetting that if they hadn't shot him and he would have killed someone else, everyone (the detractors) would have been screaming that they didn't do their job.

Armchair quarter backing, is all the detractors are doing.
