several states have anti-kickback laws

said laws do not require the person doing the suing to demonstrate legal harm, just that a kickback occured

personally, i think that kickbacks hinder free trade and the amount of the kickback is money that the plaintiff should not have had to pay

what the businesses are mainly arguing against is the award of triple damages when they get caught
