Sedition?

In US law, sedition is defined as conspiracy to commit violent insurrection against the state.

This week the outgoing President of the United States urged his followers to march on the Capitol with instructions to “stop the steal”. He had been feeding them lies for months. They took him at his word, attacked Congress and forced the members to flee. Then he called them off.

“Let us swiftly bring justice to the criminals who engaged in this rioting” – Mike Pompeo.

The criminals … but what about the instigator? Were Trump’s actions seditious? If so, what should be done?

I cannot believe that these idiots actually believed tRump when he said that he would walk with them to the Capitol.

Those bone spur attacks are so random, eh? lol

One commenter on our POS Congresscritter's FB page the other day told me that I don't know the meaning of sedition when I accused him (the Congresscritter) of it. Looks like I do after all.

In addition, there is actually a Mod on this forum that thinks the whole ordeal was "funny". 4 dead and he thinks it's funny. Truly sad.

Let me guess -- Billy, right?

I have no idea who goes by what name here. The username is /MSG/ -which I can only assume is a medical acronym for "Megla Systemic Galaticstupidity." I think that this condition is a gradual erosion of active brain cells. Apparently, his condition is in the latter stages.

Either that, or he suffers from brain poisoning from too much Chinese food.

Yeah, that's Billy. Billy has.... some issues.

Trump is one of 74,000,000 seditious people who need to be euthanized.

That's a lot of fucking needles, especially with the covid vaccines now coming out as well.

Some very serious thinking has to be done right now.

Grand Canyon mass-burial, maybe?

Trump clearly was organizing the Capitol attack.

Oh lord no, let us not despoil a beautiful area with rotten meat. Trump wanted to go to Mars. Let's just put him on a rocket and point it in that general direction.

Trump is the head of state. I don't know if sedition includes trying to overthrow yourself. It would be hard to prove the riots would not have occurred without Trump's comments. Difficult to prove.

Of course he was. He'd been tweeting about it for weeks. Notice how he couched his language in such a way so that the Cult could say "He didn't do anything, he was telling ppl to be peaceful." <wink wink>

I think inciting such action has to be an immediate result of the speech that stirred up the crowd's emotions. Something you said last week cannot incite someone today.

No. What ever you think inciting a riot means, it has nothing to do with having an immediate action.

The rioters left the #TRE45ON speech and went directly to the Capitol, where they swarmed up the stairs, broke out windows, and otherwise gained ingress into the building. It doesn't get much more "immediate" than that.

clear and present danger is "imminent lawless action"

18 U.S. Code § 2383 - Rebellion or insurrection Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.

18 U.S. Code § 2102. Definitions (a) As used in this chapter, the term “riot” means a public disturbance involving (1) an act or acts of violence by one or more persons part of an assemblage of three or more persons, which act or acts shall constitute a clear and present danger of, or shall result in, damage or injury to the property of any other person or to the person of any other individual or (2) a threat or threats of the commission of an act or acts of violence by one or more persons part of an assemblage of three or more persons having, individually or collectively, the ability of immediate execution of such threat or threats, where the performance of the threatened act or acts of violence would constitute a clear and present danger of, or would result in, damage or injury to the property of any other person or to the person of any other individual.

(b) As used in this chapter, the term “to incite a riot”, or “to organize, promote, encourage, participate in, or carry on a riot”, includes, but is not limited to, urging or instigating other persons to riot, but shall not be deemed to mean the mere oral or written (1) advocacy of ideas or (2) expression of belief, not involving advocacy of any act or acts of violence or assertion of the rightness of, or the right to commit, any

I just watched his speech and he said stuff like "walk down to the capitol," "cheer on", "demand Congress do the right thing" and "march to the capitol and peacefully and patriotically...."

To prosecute for inciting a riot a person has to urge the crowd to violent action.

I think the Dems want to get Trump so bad they are willing to stretch the law to do so; similar to all the Trump people who thought he was still going to win through some contrived far-fetched method.

You may be right. I feel (slightly) sorry for those dumb "Proud Boys" who will get it in the neck, as the nation will demand. But Trump gets away scot free because he can say: look, I told them all the right things, be peaceful and patriotic, it wasn't my fault ...

P.o.s.
