While the $500 million loan will not be directly allocated to any of the Trump-branded features, Beijing’s contribution of half the project’s total operating budget ensures the success of the broader theme-park venture.

In the context of the recent Trump effort to relax sanctions on ZTE and save Chinese jobs (which makes little sense otherwise), this is an excellent example of why we have an emoluments clause.

It would be difficult to find a more quintessential example of the kind of troubling trade practices that the president has long highlighted, which makes his sudden pivot in the case of ZTE all the more stunning.

ZTE, the world's fourth-largest maker of cell phones, was found in violation of U.S. rules against selling U.S.-originated technology to certain blacklisted countries. After reaching a more than $1 billion settlement with Commerce as reparation for its Iran and North Korea dealings, ZTE then violated the terms of the agreement by failing to fire some employees and reprimand others who were involved in the illicit technology transfers.

President Donald Trump signaled Sunday he would help a Chinese phone-maker, less than a month after the Commerce Department decided to impose a harsh penalty on the company for lying to investigators about violating U.S. sanctions by selling equipment to Iran and North Korea.


“President Xi of China, and I, are working together to give massive Chinese phone company, ZTE, a way to get back into business, fast,” the president wrote on Twitter. “Too many jobs in China lost. Commerce Department has been instructed to get it done!”

Trump’s Sunday message came as the administration said it could go after European allies if they continue to be involved with Iran.
The president pulled the U.S. out of the Iran nuclear agreement on Tuesday and vowed to re-impose sanctions on Iran, including, possibly, secondary sanctions on companies that do business with the regime.

Later, the president repeated his frequent claim that China has taken advantage of past broader trade negotiations with the U.S.

"But be cool, it will all work out!," Trump concluded.


“Those who flout our economic sanctions, export control laws and any trade regimes will not go unpunished,” Ross said at the time. “They will suffer the harshest of consequences.”

In an April letter setting out the company’s actions, the Commerce Department said the phone-maker engaged in a “extensive conspiracy,” approved by its then-CEO to evade U.S. laws.

“As a result of the conspiracy, ZTE was able to obtain hundreds of millions of dollars in contracts with and sales from Iranian entities to ship routers, microprocessors, and servers controlled under the Regulations for national security, encryption, regional security, and/or anti-terrorism reasons to Iran,” Richard R. Majauskas, acting assistant secretary of commerce for export enforcement, wrote in the April 15 denial order letter to ZTE.

In the past, lawmakers and senior government officials have raised questions about ZTE and other Chinese telecommunications companies. Republican Sens. Tom Cotton of Arkansas and Marco Rubio of Florida, and Senate Majority Whip John Cornyn of Texas previously introduced legislation that would ban the U.S. government from using ZTE’s products and would restrict the government from doing business with companies that use ZTE.

Here’s a story that appeared over the weekend in the Herald Leader of Lexington, Ky.:

“Eddie Devine voted for [Trump] because he thought he would be good for American business. Now, he says, the Trump administration’s restrictions on seasonal foreign labor may put him out of business. ‘I feel like I’ve been tricked by the devil,’ said Devine, owner of … Devine Creations Landscaping. ‘I feel so stupid.’ Devine says it has been years since he could find enough dependable, drug-free American workers for his $12-an-hour jobs mowing and tending landscapes for cemeteries, shopping centers and apartment complexes across Central Kentucky. So for years he has hired 20 seasonal workers, mostly from Guatemala, through the U.S. Labor Department’s H2-B ‘guest worker’ program. Importing these workers for a few months cost him an additional $18,000 in fees and expenses beyond their wages, which must be the same as he pays American workers. But that’s the only way he could serve his customers.

“Restrictions on guest-worker visas, which began during President Barack Obama’s second term as immigration became a hot issue for conservatives, have gotten worse under Trump. And it’s even more of a problem now that the unemployment rate is the lowest it has been in years. Devine says he lost a $100,000 account because he didn’t have enough men to do the job. …

“He isn’t alone. Cuts in H-2B visas are hurting small businesses across the country that can’t find Americans willing to do hard, manual labor: Maryland crab processors, Texas shrimp fishermen, and Kentucky landscapers and construction companies. Devine said he believed Trump’s America-first promises. But cutting off a good supply of seasonal foreign labor when Americans won’t take those jobs is only hurting American business owners and the U.S. workers they employ, he said. These workers aren’t immigrants, and there is no path to U.S. citizenship. When their seasonal work is done, they return home. That’s why Devine thinks the Trump administration’s stifling of guest-worker programs has more to do with racism than economics. ‘I think there’s a war on brown people,’ he said. “But what makes him most angry is that Trump’s properties in Florida and New York have used 144 H-2B workers since 2016. ‘I want to know why it’s OK for him to get his workers, but supporters like me don’t get theirs,’ Devine said.”
