Supreme Court rules against networks on indecent speech

1) This case was argued in November. Once argued you can't really tell the Supreme Court nevermind.

2) I don't believe that the President has the authority to decide to drop a defense to a challenge to the legitimacy of an action of an independent commission like the F.C.C.

I know, for example, that the Solicitor General is obligated to defend a statute against any constitutional challenge even if the President opposes the statute. I believe the same is true of Solicitor General arguing on behalf of a independent commission such as the F.C.C.
Hmm... True. I might be looking at it from a State view rather than the Federal view. If somebody constitutionally challenges a law, for instance, the President doesn't have the authority to drop opposition. However with the FCC, it was his appointee that would be directed to change the rules. In this case, appointing a less stringent FCC head and changing the rules while dropping opposition is definitely within his power.

Now, since the case had already been heard they could, as they did, decide to send it back to a lower court for new FCC rules and a decision on the constitutionality of those rules, but if Obama changed them, as he can, again the lawsuit would lose any momentum because it would be moot.

I know that our society is evolving to be more European...... I hate it. I also know that folks would like their evening television programming to be more European as well (ever watch those commercials programs and see where the most vulgar and risque commercials come from) and I hate that as well. As long as this country can hang on to some curbing of language on regular programming I will be for it.

I like to watch the television show "The Mentalist," regular CBS programming. Was watching it last night and the show involved the mob. The language was so bad during the first 10 minutes I turned it off. I refuse to accept that they can't make a show interesting or entertaining without the cussing. I know I have to option to "turn it off" but I guarantee you that within a year of no regulation I would be relegated to watching only shows on Nickelodeon or Disney (some of that is questionable) or whatever.
 
Leaningright has a peculiar sense of morality. Homosexuals loving one another and cursing are the worst atrocities known to man.

Not the worst Water.....one just as bad as the other, that's all. And you are right, my "sense of morality" does seem to be "peculiar" and sadly seems to be becomming more peculiar as time goes on. :(

Well LR, I generally dislike gratuitous profanity as well, mainly because I consider it childish and sensational. Profanity for the sake of profanity is idiotic. I'm not a child who gets awed and excited every time he hears someone say the word "sex".

But where did the "immoral" nature of profanity come from? It just evolved into the language. Ultimately, the taboo on profanity is completely arbitrary and silly. What are those words going to be when when they're not taboo anymore? Just words. And who's going to care then? Imagine all the words in history that all cultures have artificially deemed taboo. The taboo eventually evolved out of most of those words. Is there something wrong with that? It's just a process that happens to language. There's nothing wrong with it.

yes, you do have the option, but you MUST realize that people in normal everyday life outside of your home also use bad language and expletives, right?

Yep, I'm not an ostrich. But if someone uses that kind of language in my house they are asked not to or asked to leave. If the TV starts spouting that sort of language I do change the channel. If someone in public starts spouting foul language I walk away. My point is that if let go unchecked, public television will progressively get worse and worse. I don't want it to so I am happy with this decision.
 
From my point of view i think it's rather strange that "European" tv is seen as being the harbinger of doom.

The programmes which immediately spring to mind when i think of a vigorous dose of sweary content are 'The Sopranos', 'Deadwood' and 'The Wire'. We do get quite a lot of sex on UK made programmes though, which is nice.

Much more in favor of nanny state moralisms that a meager few find objectionable or have a hard time changing the channel on.

All three of those are pay cable programs but I would wager many on the extreme right would like to see them punished as well

Not this extreme rightie. If people want to pay for smut, or off themselves then as long as I don't have to see it or clean up after it all's fine with me.
 
I would have no problem if they were going to try and limit the violence, but the language? If you watch much tv and bad words are the worst you experience, you have had a mild experience.

And what I think is far more dangerous is the pervasiveness of the "be slim, be beautiful, and be popular" ideology over anything of substance.

But the politicians (and judges) want to address bad language and let the killings on tv continue, far be it from me to object. I can still laugh though.
