The Eighth Amendment

When evaluating whether a fine is excessive, a criteria is the party’s ability to pay. UNDER OATH, Trump claimed to have $400 million in cash. So, does he or is it also perjury?
Just because a person has cash does not mean he does not have bills for that cash to go to. This is going to the SCOTUS . BTW: Did you hear the SCOTUS ruled against the Biden administration today. ;)
 
The white collar criminals take a lot more money than poor criminals do. They commit crimes that are in millions and sometimes billions. Trump should not get a 1000 dollar fine for the magnitude of his crimes. Bigger money crimes get bigger fines. The fine is supposed to be substantial enough to make the criminal think twice before doing it again. The 5 million dollar fine was not enough to teach the ignorant Trump anything for lies about Carroll. He has been much quieter since the 90 million dollar hit.

The largest fine in history against a private individual for a crime that has no victim and where the banks suffered no loss and would do business with Trump in the future seems a bit excessive. :laugh:

Not only excessive, he wasn't even convicted of any crime.

There is a reason real estate investors are leaving New York.
 
The more I watch this particular case continue, the more i'm inclined to believe that this is nothing more than a Democrat scheme of political warfare on a scale never before seen.

The Democrats must be terrified of Trump running and winning again.

I think that's pretty obvious.

Not terrified enough to nominate someone with a functioning brain without regard to Biden's wishes.
 
Are executions cruel and unusual punishment? It seems worse than a large monetary fine.

The fine, of course, does not reflect a single incident. The verdict was for decades of fraud. Amortize that fraud over the decades and perhaps it’s a proper penalty.

There was no bail or fine in this case.

There was a bond required after disgorgement.
 
The “no victim” defense is comical, ah, he broke the law, using illegal means, he cheated and lied to get an advantage over others.

As I said before, the next time you get ticketed for running a Stop sign just tell the Judge there you shouldn’t pay a penalty because there was “no victims”

And the amount was what was estimated Trump cheated plus interest for the years it was a common practice for him

Yet NO ONE was ever prosecuted under that law. Ever.
