Amendment 7 guarantees you the right to a jury trial in all civil cases involving over 20$ but this obama judge arbitrarily said that rudy did not turn over some requested information so his constitutional right to a jury trial is cancelled and all that is left now is to determine how much he has to pay. This is all wrong - default judgements are for cases where the defendant does not show up and that is not what happened here. Same thing was done to alex jones.

sep 3 2023 On Wednesday, Georgia Judge Beryl Howell ruled against the former New York City mayor in a civil defamation suit brought against him by mother-daughter state election workers, Ruby Freeman and Shaye Moss. Giuliani, acting in his capacity as a legal adviser to Donald Trump, previously made false claims that the pair had committed fraud during the 2020 election, making them two of the most prominent targets for the ire of the former president's supporters.

Howell's ruling against Giuliani was by a default judgment, as the judge found that he had failed to comply with a number of subpoenas, particularly those pertaining to the lawsuit's discovery phase. The judge, in a 57-page opinion, called the discovery materials that he turned over insufficient. A jury will now decide how much Giuliani must pay to Freeman and Moss for his defamatory remarks. Additionally, Howell ordered Giuliani to pay Freeman and Moss' legal fees and costs, which CNN reported could amount to thousands, if not millions, of dollars

What happened to the 7th amendment guarantee of a right to a jury trial in all civil cases over $20? Judges can't simply say - "I don't think you are cooperating so we skip the trial and i pronounce you the loser."

This is how alex "jones" lost his civil suit too. Liberal judges are totally corrupt.

Here's the 7a:

In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.


A judge cannot simply cancel that right.
 
It’s called summary judgement you stupid fucking ass clown. There was no issue of fact at dispute therefore nothing to try in court. Rudy in essence pled guilty. No trial needed. Fuck TDAK is a fucking moron.

WRONG.


No Republi'can' will be allowed, or should be allowed, special access to the courts where they can give the middle finger to requirements.

It is a stupid derp reading of the 7th amendment to say 'regardless of meeting requirements you still get to go to trial'.


Imagine if Derp logic ruled. That wrong doers could simply REFUSE to submit all the required evidence and then get in court, in front of a jury, who then said 'Not liable as we did not see evidence of wrong doing'.


This derp logic would empower EVERY SINGLE wrong doer to NEVER provide any documents or evidence in discovery because the lack of evidence will serve them with a jury.

Thus why smart courts and people (read.. Dems and NEVER republi'cans') will continue to require adherence to the law and rules and the threat of Summary Judgement as punishment if a wrong doer, refuses to cooperate with the court and law.

Well then this is not only an easy appeal for Rudy but also this judge will face Aileen Cannon type admonitionment by the Superior Court for going outside the law, and worse for lying as a judge.


BUt we all know how this will go, just as we knew how it would go when Rudy went in to court on the Trump Derp Election fraud stuff, and in court he would say 'no your honor we are not arguing fraud' and then lose, but then immediately go out to the Press and say 'they proved fraud', knowing the derps would eat it up.

And yes the Judge has the authority and obligation to do summary judgement and cancel his trial, when he refuses to cooperate.

If you sue me for breach of contract and I say ‘yep I breached the FUCK out of that contract and I am prepared to stipulate that I did because I can’t afford discovery and I have nothing in the way of anything exculpatory so let’s just get on with the trial’ his is what would happen to me. And that is the scenario that this case has reached.
