With the CDC telling states to prepare for mass distribution of a possible vaccine by November 1, many people are wondering if that vaccine could be forced on them. Is that possible?

The short answer - yes.

Aila Hoss, Asst. Professor of Law at the University of Tulsa, said, “A good example of that is some state laws will require nursing homes to ensure that their employees and even their patients/residents to be vaccinated for influenza every year.”

Ms. Hoss is a former public health attorney for the CDC. She said there is a precedent set for state and local governments mandating vaccines - notably a Supreme Court case from 1905 – Jacobson v. Massachusetts.

Ms. Hoss explained, “That was an instance where state government was allowing local governments to require mandatory vaccinations, and that was upheld by the Supreme Court as constitutional because it is both the responsibility and the duty of government, like states, to protect and promote the public health and welfare of their citizens.”

It’s something New Yorkers in several Brooklyn neighborhoods saw just last year when a measles vaccine was mandated for residents after an outbreak.

Virginia Health Commissioner Dr. Norman Oliver said in a recent interview with Richmond television station ABC-8 (WRIC-TV), that if he is still Virginia’s acting health commissioner when a COVID-19 vaccine is made available, he will make immunization mandatory. Virginia law currently gives the health commissioner the authority to issue a mandate for a vaccine. The state constitution states the commonwealth’s executive power is vested in the governor.

Dorit Reiss, a law professor at the University of California Hastings College of the Law in San Francisco, told TODAY, that refusing to follow a mandate could mean a fine, tax or other penalty, said Reiss, who studies legal and policy issues related to vaccines.

She expected COVID-19 hot spots would make the vaccine a requirement for its residents.

The federal government has ways to get people to vaccinate, imposing it as a condition of getting a passport.

States have the authority to regulate public health and they have in the past mandated vaccines. The classic case in this area of law, Jacobson v. Massachusetts in 1905, was decided by the Supreme Court after a smallpox outbreak.

Your employer could fire you if you refuse. “It's perfectly legitimate for an employer to regulate to make the workplace safer,” Reiss said. “They can certainly fire you if you don't want to follow health and safety rules. I expect there are also going to be a lot of workers who are grateful that their employer is trying to make the place safer for themselves and others.”

Airlines, restaurants, stores and stadiums can make the vaccine a condition of doing business with you.

“They can decide to refuse service to you for pretty much any reason,” Reiss said, pointing out a policy most shoppers are already familiar with: no shirt, no shoes, no service.

“There are people who don't like mandates, period, and they won't like this either,” Reiss said.
