I don't think issues like this should ever come up.

The legal language should be quite clear as to who gets the flute.

I believe in big government, remember?

A gets the flute and sues B because A believes they are a woman and women don't get paid as much as men.

B hires C to clean the toilets but C is a leftist shit stain who thinks cleaning toilets is worth 15/hour so goes on strike.

C is angry that he doesnt get paid enough so does crack and holds a gun to a prgenant lady's belly to get money from her. Then he tries passing bogus bills to buy shit and then won't get in the police car when arrested.

Well, there's always the Solomonic approach... You tell the kids you're going to break the flute in to three equal pieces and give each of them a piece because that's "Fair and equal." Isn't that the Progressive approach to these things?

Possibly, but irrelevant. I have the flute in hand according to the example. There are three children present who want it. I break it into three equal parts and give them each one. That's fair. Of course, I could wait for their responses to my decision and base my actions on that. I'd expect the responses to be:

A. Well, I guess if that's what you want to do...

B. No! I spent lots of time and materials on making it! Don't destroy it!

C. Whatever...

B would get it because she's the only one that cares about the flute. The other two are essentially getting a variant of Fruit of a poisonous tree. That is, they are being rewarded for doing nothing with C being the least worthy of the group.
