The three-judge panel concluded that Trump’s actions as a candidate for president would not automatically be protected by “presidential immunity,” turning aside Trump’s sweeping argument that nearly all speech and conduct by an incumbent president should be shielded from lawsuits, including several brought by members of Congress and injured police officers.

“When a first-term President opts to seek a second term, his campaign to win re-election is not an official presidential act,” wrote Chief Judge Sri Srinivasan of the D.C. Circuit Court of Appeals. “The Office of the Presidency as an institution is agnostic about who will occupy it next. And campaigning to gain that office is not an official act of the office.”..

However, the appeals court left the door open for continued efforts by Trump to try to prove that he was acting as president, rather than as a candidate for reelection, when he addressed the angry crowd at the Ellipse.

The ruling, which Trump could challenge at the Supreme Court, is likely to reverberate in the federal criminal case where Trump is charged with seeking to subvert the 2020 election. Trump has also contended that he is immune from prosecution in that case by arguing his efforts were connected to his official duties....


...Though the appeals judges permitted the lawsuits to move forward, the court emphasized that Trump could still seek to prove he was acting in his official capacity as president when he exhorted the Jan. 6 crowd to march on the Capitol to “fight like hell” and “stop the steal.” ...
 
Yes, hopefully the civil suits will bring justice.

It is a monumental failure of President Trump to not prosecute Trump for the violent coup attempt.
 
Public officials are immune from lawsuits. If they aren't, should we sue Biden too for not enforcing immigration laws? I'm sure we can come up with damages. I know Texas has spent billions.

Every legal challenge is nothing but a stalling tactic. He NEEDS to get elected in order to stay out of prison

Of course, overthrowing the government is not a list of duties for a president. That is not included in duties. Nor if he robbed a bank while being in office.They are not immune .

The only immunity public officials have is for acts committed as part of their official duties. For instance, if Trump hadn't been a total moron during the pandemic and had ordered shut downs, and someone sued him for loss of business -- too bad. Protecting Americans is part of his job description. On the other hand, if he had shot someone on Fifth Avenue he could be sued and/or prosecuted.

I was going to ask you if you were really that stupid but we both know that answer, and yes you are.

NO. In fact Public Officials DO NOT get immunity for acts done outside their job function. If a public official drinks and drives and harms you in an accident you can sue him. that is how the system works.
