A U.S. federal appeals court has ruled that President Trump’s sweeping tariffs were imposed illegally and unconstitutionally. In a 7–4 decision, judges found he overstepped by using the International Emergency Economic Powers Act (IEEPA), which does not give presidents authority to levy import taxes without congressional approval.

The ruling affects Trump’s so-called ā€œLiberation Dayā€ tariffs and additional duties targeting Canada, China, and Mexico. A lower court had already struck them down earlier this year, but the appeals court now confirms that only Congress has the constitutional power to impose tariffs.

Despite this, the court allowed the tariffs to stay in place until October 14, giving the administration time to appeal to the Supreme Court. Other tariffs Trump imposed under different legal authorities, such as Section 232 on steel and autos, remain unaffected.

This case could have far-reaching consequences: if upheld, it will limit how far any president can stretch ā€œemergency powersā€ to bypass Congress on trade and taxation.
