aparently when he found god god gave him some drugs.

RICHMOND, Va. -- Stricter release conditions were imposed on Michael Vick on Wednesday after he tested positive for marijuana use on Sept. 13.

Judge Henry E. Hudson restricted Vick to his home every day from 10 p.m. to 6 a.m. at the request of Vick's probation officer, Patricia Locket-Ross.

Vick will be required to wear an electronic monitoring device to ensure his compliance with the order, court documents said.

Judge Hudson also ordered that Vick continue to participate in substance abuse and mental health counseling

Ohh silly me he is a celebrity with the all the extra rights thereof.

I don't think that's it. He failed a drug test; I don't think that actually having the metabolites of a drug in your system is technically against the law. He can't be charged with possession unless the definition is changed, or with selling, or anything else on the books.

Umm traces of MJ in your system will get you a DUI and possibly vehicular manslaughter ....

One problem with legalizing MJ. What is the intoxication limit and how to test for it.

OK, but that's a measure of impairment, and the consequence of doing something that either has injured or killed someone else or poses the risk of doing so.

It's possible to fight the DUI on the basis of a blood test if the test was made only on metabolites and not on unmetabolized marijuana. Those substances are the breakdown products of MJ and because they're lipophilic will remain in your bloodstream, in steadily decreasing concentrations, for about 30 days. You can't be considered impaired on that basis.

He wasn't driving

If alcohol is legal which is far more imparing, that shouldn't be an impediment to MJ.

I suppose that there is something already in the literature about intoxication levels, but it would be highly subjective, I think, given the reported differences among people's responses to it. Based on the little information I have at hand, I'd recommend that no levels are safe to drive. At the same time, the testing must be refined to evaluate levels of unmetabolized THC and not the metabolites.
 
Vick is out of bond. A condition of his release is no drug or alcohol use while out on bond. WHen you are out on federal bond you get a PO for that time. I am sure they did a UA, found THC metabolites, established a baseline and then upped his release conditions to included home restriction and electronic monitoring.

But on the Vick issue, it would seem to prove he has been using a controlled/illegal substance in the last 30 days.

I don't think that matters, legally. Unless he was found with MJ in his possession, I think he walks. Have the laws been changed to include having the drug or its metabolites in one's system?

the question should be, why is he in trouble for marijuana use in the first place?

his rights are being denied!!!!!!
