So? Lots of criminals have family. Is sending someone to prison as punishment for a crime they committed and were found guilty of cruel just because they also happen to have a family?
Although the Court is reluctant to give evidentiary weight to the Respondent's clothing as an indication of gang affiliation, the fact that a "past, proven, and reliable source of information" verified the Respondent's gang membership, rank, and gang name is sufficient to support that the Respondent is a gang member, and the Respondent has failed to present evidence to rebut that assertion.
The government had informants (plural) that testified he was a member. They likely had other evidence presented to back that up but it isn't in the ruling I posted, just the finding. So, there was sufficient evidence presented to corroborate the claim and since Abrego-Garcia failed--and I assume his lawyer didn't do anything on this either--to put up a defense to the claim, it was accepted by the court.
The administration is pushing back because these judges are making an administrative action into a criminal case which it isn't and further demanding that defendants get not just a hearing, or their day in court, but repeated days in court with repeated hearings, appeals, and such. The judges are deliberately trying to clog the machinery of deportation up to the maximum extent they can to keep persons who are deportable in the US.
America loses. A man innocent of a crime, with a family was taken to a country that was willing to keep him and many others forever and torture them at will. This obviously was worked out in advance, before the election. How much is that costing in money, besides the cost in international respect? This admin is inhumane. Trumpys are not even ashamed of actions like this.
