No, it wouldn't. The guy had his day in court and on 17 Oct. 2019 was ordered deported. Biden stopped that with an administrative order because dude was an MS 13 (so the court found) member and his return to El Salvador would mean he'd get tossed in CECOT the moment his feet hit the ground. This horrible exercise in imprisonment of a member of a declared (both in the US and El Salvador) terrorist gang and organization was an affront to the radical Leftists running the Biden administration so they quashed sending him back.

Trump lifted the administrative hold and sent him to rot in an El Salvador prison. Now, some Trump hating judge wants a do over and for Trump to bring this POS back to the US so he can be adjudicated a terrorist and gang member properly before he gets deported a second time.
Supreme Court unanimously disagreed.

The judge should travel to San Salvador on his own and deliver his order to Salvadoran officials.

There was no mistake. There was a warning to all that if you're here illegally you may want to weigh going back home on your own to the possibility of ending up in El Salvador.

At some point, once the SCOTUS has told them they have to "facilitate" his return (which they have), even Trump needs to just say, "oops" and fix the problem instead of trying to double down on a mistake, one that even they have said was a mistake.

Now we are getting to a level of obstinance that will simply allow this guy to stay once all is said and done, if they had just had the hearings the courts ruled they should have. You know, hearings to prove they are actually members of the newly minted terrorist organizations list, they likely could have deported him elsewhere as deporting him to El Salvador was not an option. Now, because they keep trying to avoid responsibility, it is likely this guy will be a guest of the US for a long time time come.

They can give their evidence at a judicial review.

The State Department has the authority to deport members of a terrorist group (either Tren de Aragua or MS-13).

The main difference is he'll be deported to somewhere other than El Salvador. However, the more they try to dig in their heels, the more likely this gentleman will have cause to request Amnesty. My guess is by the time he gets back here, after all their reticence to correct this mistake, one that the Administration says was a mistake, he'll have been a victim of violence from El Salvadoran prison, etc.

IMHO, just correct it as quickly as possible, don't give the leftists a poster child.

It was a jurisdictional matter. He should have not been sent to El Salvador.

He can be sent anywhere the State Dept. deems appropriate.
