Is The United States Drug War Unconstitutional?

If the Congress of the United States and the federal government found it necessary in the year 1919 to amend the Constitution to prohibit the manufacture, transportation and sale of intoxicating liquors, why did they not find it necessary to amend the Constitution to prohibit the manufacture, transportation and sale of some particular drugs?

Is the United States Drug War unconstitutional?

reefer madness was created to be a terrifying nightmare to our white women, so the CSA was allowed to go unchecked for government power to make us feel safe and protected

I've asked this many times in the past...

That amendment was needless and foolish ergo its reversal so very quickly.

Not really, it made it the law of the land across all the states not just the ones that wanted it. Without it, each state's laws applied and many simply didn't want it and would have fought a centralized response to what was seen as a social "ill". They were successful in forcing the entire US to enforce stupidity and created the black market that put people's lives in jeopardy. But back then we actually stopped doing crap that sucked so bad it created tornadoes... we went and repealed the Amendment.

Reefer Madness was created as porn that could be shown in regular theaters... Otherwise most of the authorities would have shut down a stupid movie with all the sexual stuff in it. It was a profit taking movie, not one issued by the government.

OH silly damo, you know the powers that be use private as well as public propaganda organs to accomplish their goals. Or maybe you don't. It doesn't have to be "issued by the government" to be propaganda in the drug war.

According to the 10th amendment anything and everything not specifically delegated to the federal government by the Constitution is reserved respectively to the States or the people. Ergo, since there's no constitutional authority for a federal prohibition of any product manufactured or otherwise the feds most certainly have to get an amendment to our Constitution to prohibit same. Ergo, amendment 18 of 1919 was perfectly necessary, honest and respectful constitutional decorum. The reason it was repealed rather quickly was in those days there were fewer blithering authoritarian idiots in Washington and the politicians quickly saw the horrible unintended consequences of the insane War On Alcohol.

The question of this thread remains unanswered. Is the United States Drug War unconstitutional?

I say yes because there's no constitutional power listed in the Constitution that allows the federal government to prohibit anything not enumerated in the Constitution. The politicians in 1919 understood that fact and thereby passed a necessary amendment to prohibit alcohol. No such amendment was ever even proposed to my knowledge to prohibit some drugs.

What say ye?????

it is indeed unconstitutional, considering that 'constitutionally' the feds have no police power and they can only regulate interstate commerce.

Yes.
It was instituted by a criminal president who was kicked out of office for his crimes. Of course it is unconstitutional.

Yes, it is unconstitutional to prohibit mind altering drugs used by idiots, morons and the loser dregs of society. Open the flood gates and allow the drug cartels to profit by killing our citizens and causing mayhem.

Hell, while we're at it, let's just disband the police; who needs them right? We should also allow the citizens to own hand grenades and machine guns. After all, the Constitution doesnt limit what it means to "bear arms"!!

Legalizing reduces or eliminates the profits of the drug cartels, moron. Next time, think, then post.

Wrong again shit-for-brains; but I'm amused by your dimwitted simple minded belief that legalizing harmful drugs will eliminate black market criminal enterprise.

You never think before you post; how ironic that you claim others don't. Hell, I'm willing to bet you don't have the capacity to think...you first must have a brain.

Retard; how can a black market exist for something legal?

You really are too stupid to even begin to comprehend the irony in your remarkably stupid comments.

If it is Constitutional to shoot up heroin, who do you think will be supplying it? A Government sponsored heroin manufacturer?

If the Government decides to compete with cartels by regulating and taxing heroin, do you naively think the cartels would not conspire to undercut their costs and sell it cheaper in a black market?

I'm sure a simple minded cluekess buffoon like you would think that legalizing deadly drugs based on some moronically naive concept of Constitutional ideological purity will cause the illegal drug cartels making BILLIONS to just throw up their hands in dispair and call it quits.

The only dunces not thinking are dimwitted naive unthinking twits like you who make incredibly stupid arguments that suggest that drugs are a Constiturional right while claiming the FDA is protecting its citizens from "drug" companies.

You can't begin to comprehend the irony because you really are too fucking ignorant and stupid to grasp even the most obvious.

1. The only drug we want legalised is pot.

The fact that you don't know this speaks loud and clear about your complete ignorance. You are the closest thing to a human mirror I have ever encountered. The exact insults you hurl at others are most true about you.

Marijuana is the third most popular recreational drug in America (behind only alcohol and tobacco), and has been used by nearly 100 million Americans. According to government surveys, some 25 million Americans have smoked marijuana in the past year, and more than 14 million do so regularly despite harsh laws against its use. Our public policies should reflect this reality, not deny it.

Marijuana is the largest cash economy in the United States.
Any user will tell you that they would gladly pay a reasonable tax to be able to walk into a nearby store and buy a pack of Panama Reds or Maui Wowie Or Humbolt Counties.

The tax stream would cure government revenue problems and if medical patients are allowed to grow their own then it is monetarily fair to the most vulnerable members of society, unlike many other issues of today.

You're losing it. Legalization will get the cartels out of the business, and get the violence out of it. And yes, citizens should be allowed to have grenades and machine guns. Your sarcasm has backfired. doh.

Dear dumbass; you might want to re-read the thread topic. It is about the "drug war" being conducted by the Feds as being unconstitutional.

You're selective ignorance is hardly a surprise though.
