So we have a US born American citizen being held without trial

I suspect you believe that because Walt saying that Mexico doesn't recognize dual citizenship? As I told him, unless there's a difference between recognizing and allowing dual citizenship, that hasn't been true since 1998:

I'm making mere speculation here. I don't know all the details but I'm also not going to give this guy, by default, a pass either.

Not all crimes are the same, Terry. Sad you don't understand that point.

Illegal entry is a misdemeanor under Federal law.

That is sufficient to cause you to have your green card revoked and citizenship application cancelled.

OTOH, attacking police, destroying public property and threatening to murder elected officials are Federal felonies...crimes which your Orange Messiah pardoned.

Ones that can be charged but if you are a citizen that won't get your citizenship revoked, ignoring your whataboutism and mischaracterization of my position on Trump. I get it, that you see anyone who so much as acknowledges some one-time, single action by Trump positively as evidence they are evil and to be opposed--like Bill Mayer did for example. Your TDS has completely consumed you.

I'm good with that...given Due Process is followed.

Why do you support not following Due Process, Terry?

Lucas Denney of Texas, for example (see my post above).

I just did. That's one case, there are others.
Are you talking about this Lucas Denney?

Denney was arrested on Dec. 13, 2021, in the Brackettville, Texas, area. He pleaded guilty on March 17, 2022, to an indictment charging him with assaulting resisting, or impeding officers using a dangerous weapon.

Can you explain how someone that pleaded guilty was held without a hearing? Who did he plead guilty to?

You do realize that Dec 2021 to March 17 is nowhere near a year long, right? He clearly was not held for over a year without an indictment.

Then when we go look at the actual court record... we find the grand jury indictment...

So let's see what facts you got wrong...
Some were arrested, jailed without bail, and not even indicted, (False - He was indicted.) like Lucas Denney of Texas. He was arrested in Texas and charged with several felonies. He was then transferred to the DC jail system where he sat for months without an indictment (required by federal procedure within 30 days of arrest),(False - He was indicted by a grand jury in February of 2022.) never given a preliminary hearing, (False - There is no need for a preliminary hearing when an indictment by a grand jury occurs.) and sat in jail for over a year in that status. (False - He plead guilty within 3 months of his initial arrest.)

This is his appeal and includes a partial transcript of his plea hearing.

Now that we have dispensed with your ridiculous claim that Lucas Denney was held for months without an indictment and sat in jail for over a year without a hearing. Do you have any other names you want to present that were held in jail for over a year without a hearing?

If the nation you became a citizen of does not recognize dual citizens then you many have done just that without recognizing you did.
And it seems you are just talking out of your ass once more. Mexico clearly allows for dual citizenship so the question of whether he holds Mexican and US citizenship is moot since you don't have to give up US citizenship to get dual citizenship with Mexico.

I think this may be the test case for Trump's "birthright citizenship" EO that supposedly cancels citizenship based on just being born here when the parents were here illegally...

In order to get it into courts someone has to be the first to be arrested, and it seems that this may be the unlucky dude that gets to test Trump's theory.

I will follow this one (we should regardless) to see if I am right on this, but I think that they found the first test of that EO.
I doubt that Trump's EO is legal, but it is logical if one wants to clean up this country from the damage Brandon did with his autopen over the preceding four years.

"You don’t see this very often in federal court, but one of the January 6 (J6) Defendants, Lucas Denney, is being held illegally. He was arrested in Texas on December 13, 2021, and brought before a federal magistrate, who ordered him detained without bond on a criminal Complaint. It then took six weeks to transfer him to DC, where he is currently being held. He has not appeared before a federal judge in DC since his arrival, although that will change Monday afternoon as a result of his lawyer seeking his release.

Denney’s case involves two distinct, major screwups. The first is that he was not afforded a Preliminary Hearing, to which he is entitled under the Federal Rules of Criminal Procedure and the Constitution. The second is that he has not been indicted by a grand jury within 30 days of his arrest, as required by the federal Speedy Trial Act. Consequently, Denney’s detention has been unlawful since at least late January 2022.

The Department of Justice (DOJ) alleges that Denney participated in the riot on January 6, 2021, in Washington D.C. at the United States Capitol. It charged Denney with five felonies: assaults, civil disorder, and obstructions of an official proceeding, and with seven trespassing misdemeanors. An arrest warrant was issued for him in December 2021 based on a criminal Complaint sworn out by a law enforcement officer, not on an indictment returned by a grand jury."
This entire argument was made moot when Denney was indicted. He was not held for a year without a hearing. He was not held for months without an indictment.

People can be arrested without an indictment. There were some minor errors made with Denney not being indicted within 30 days of arrest but by the time his lawyer filed a motion, he was indicted and the arguments were moot. The argument could be made that he was held for 30 days in violation of his rights but that is less of an error than sending someone to El Salvador in violation of a court order.

WASHINGTON D.C., DC — The Department of Justice has arrested more than 535 people for taking part in the January 6 insurrection on the U.S. Capitol building. Some of those trials are months, possibly years away.
Verify viewer Kelley from Alexandria, Virginia asked the Verify team if some of the accused remain behind bars nearly six months later.

“Is it true people arrested [for crimes on January 6th] are still being held in jail with no bail," she asked in an email. "What are the charges?"
Let's Verify.

THE QUESTION

Are people accused of participating in the January 6th insurrection on the U.S. Capitol still being held in jail without bail? If so, what are their charges?

OUR SOURCES

THE ANSWER

Yes, several people are being held without bail in the D.C. Jail for crimes they allegedly committed during the Capitol riots.

or,

Jail violated civil rights of Capitol riot defendant, U.S. judge says

Being denied bail is not a violation of anyone's civil rights. Being denied bail means they had a bail hearing and the judge determined they were a risk.
