there are a few federal appeals court decisions and I believe one supreme court decision that says public servants in the performance of their duties have no expectation of privacy.

You can record a conversation that you are having with someone else and you're not reguired to tell them that they're being recorded.
You just can't record a conversation between two other people where you're not part of the conversation.

You can tape record or video tape a Police Officer stopping you and you're not required to tell them, nor can they legally tell you to stop recording or confiscate the recorder.
