Since no one was shot, you statement is a strawman; but an answer would be:

No; you would not have infringed on their freedom of speech, by shooting them.
You would have infringed on their right to live; because we have no right to kill someone, unless it falls within the parameters set forth by society.

That is not specifically covered in the constitution.

I can understand why the employer did as he did, but I do not belive that keeping her employed is in anyway tacit approval. Personally, if she were the best for the job, I would have wanted to keep her. If I was not going to survive as a business if I kept her, I would likely cave on what I felt was right and let her go.
 
Someone who behaved like that would not likely have been employed by me in the first place.
