So I suppose if someone mugs you when you're passed out drunk, and he's caught on camera, the state shouldn't prosecute the mugger? This equivalency is nonsense.

Anyway, I think few would agree that some degree of alcohol drinking isn't enough to remove a persons ability to consent to sex. Otherwise, we'd ban most sex.

Where is the line drawn? That's a dumb question too. If a person sexually assualts another with out their consent they have crossed the line right there and committed the violent act of rape. I don't care what the scenerio is. You're trying to create gray area when there is in fact very little. To determine if a person has been raped you need only answer two questions. Was the person sexually assualted? If the answer is yes the next question is, "Did they give consent to have sex?". If the answer is no, that person has been raped.

What you are doing is confusing rape with statutory rape.
