It is no more fallacious than your attempts to ban guns. They are just inanimate objects that in and of themselves do not impact behavior

I'm trying to ask you simple questions that will either agree with the logic or show the logic to be invalid....I didn't mention mini-skirts or how a women might
dress at all.....if the questions are too hard for you, just stfu.
If you incite an action, are you responsible or the party that actually committed the action ? Or both ?

similar cases have already been judged in the courts, you're obviously not familiar with them.

No I don't agree with your logic. In fact you're not using logic at all. A person practicing their freedom, within the law, is in no way a justification for anyone to committ an act of violence upon that person for any reason regardless of provocation. This is what it means to live in a civilized society under the rule of law.

Pleading in the alternative is generally permitted in criminal cases, a defendant may claim to have not committed the crime itself, but at the same time may claim that if the defendant had committed the crime, the act was excused for a reason such as insanity or intoxication, or was justified due to provocation or self defense.

Call a Black American the N word, and when you get out of the hospital, try to have him prosecuted....see who wins....

Being drunk is not a defense unless intent is required to prove guilt.

Wearing a miniskirt can not be said to provoke a violent response and you are comparing a rather extreme difference in degree. You might want to rape that dude in usc's photo but no sane person would count his skirt as legitimate provocation. It's not even a legitimate provocation to beat him up.
