I can kind of see the hospital's position, but they should have told the father either he will stfu and behave or not be allowed in the hospital. There is no reason to reward his threatening behavior.

Forty-nine-year-old Tonya Battle tells the Detroit Free Press she didn't know how to react when she learned about the request in October at Hurley Medical Center in Flint. Battle sued last month in Genesee Circuit Court seeking punitive damages.

Battle's lawsuit claims a note was posted on an assignment clipboard reading "No African American nurse to take care of baby." She says it was later removed, but claims black nurses weren't assigned to the baby's care for about a month.

Hurley President Melany Gavulic said in a statement Tuesday the father showed Battle's supervior a swastika tattoo, which angered the staff. She says supervisors were concerned for the staff's safety.
 
And she's suing the hospital, rather than the man himself which indicates to me that she's more interested in money than she is in getting the actual prick behind the rather silly request.
 
If it had been a note saying no black nurses caring for the man, I might buy it.

I have never known a nurse I thought capable of hurting a newborn because of the father's ignorance.

What grounds does she have to sue the guy? I'm not sure being a racist asshole is legitimate grounds for a lawsuit. She has more than ample grounds to sue her employer.

Sue the employer for relaying the request of a customer? They weren't being racist pricks, he was. She's just in this for the cash, rather like most people who sue.

They said they were concerned for the safety of the staff not the newborn. If that had been their claim I would be less sympathetic to the hospital.

I don't necessarily doubt the hospital but they should not have given into the father out of fear. He doesn't need to there and frankly if the mother had a problem, I would tell her we can arrange to tranfer you to any hospital you like at your expense.

And then they'd deal with a lawsuit from the father. The problem is as this point if you're a large business people are going to find ways to sue you for trying to deal with stupidity on all sides.

No, not for relaying the request of a customer. For agreeing to it and implementing his racist request. It's pretty basic employment discrimination.

And maybe she is in it for the cash, but I don't see why that's a problem. That's the way these laws work. The disincentive to discriminate against people is that if you do it they can sue you and you will have to pay them money.

If the father had asked not to be served by nurses under 5 ft 1, it would be equally silly ad still his choice. There are other nurses and does this particular woman have some kind of attachment to this kid? It's not her kid, I think she can handle the horror of not having to deal with one more squalling kid. Seems more to me that she was probably walking past, saw the sign and thought, "Jackpot, time to get one of those 10 million dollar settlements and retire" since apparently her emotional trauma can't be compensated with anything less than a seven digit paycheck.

There are some request you should not honor. What if his request had been for only hot young nurses? The hospital will attract a certain class of customers based on what they accomodate.

The hospital has an obligation to the health and safety of the infant, to that end... I could understand if they moved the nurse temporarly for a day or so to get it strightened out... but anylonger than that and its clear employment discrimination, I dont know what her damages are.

Well, until anti-discrimination statutes are passed that prohibit discrimination against people of short stature the two are not the same. And while you may view the request as "silly," I don't think there is anything silly about it. It also isn't silly to me that this nurse's bosses agreed to the request of a racist asshole.

If just a few patients start demanding certain types of nurses then it would create a logistical nightmare. If enough say no black nurses then there would difficulty in finding hours for african american nurses.

Well if they were doing it out of concern for the nurse's safety from the man with the swastika, I can see that. I would think they have to take that as a possibility and have some responsibility to protect their employees. Though they could have handled it differently... for example by going to the employees and letting them be aware of the request and then allowing the employees decide.

You don't know what her motivation is.
She's suing a large organization over racial discrimination when most people would shrug it off as stupid and move on.

You can get worse discrimination than this by wandering around the internet, her "damages" are non-existant. Some guy was a racist prick, end of story.
