Republican North Carolina state legislators have proposed allowing an official state religion in a measure that would declare the state exempt from the Constitution and court rulings.

The bill, filed Monday by two GOP lawmakers from Rowan County and backed by nine other Republicans, says each state "is sovereign" and courts cannot block a state "from making laws respecting an establishment of religion." The legislation was filed in response to a lawsuit to stop county commissioners in Rowan County from opening meetings with a Christian prayer, wral.com reported.

I just knew the same nutjobs so outraged over the supposed assaults on the 2nd amendment would be silent as a church mouse over this latest conservative attempt to establish an official religion and begin to turn this country into the theocracy they've always wanted.

Congress, as provided for by the Constitution, did not exist in 1774. Regardless, whether a prayer is "respecting an establishment of religion" is debatable these people are saying they don't care if it or any other act of government within NC does.

Rowan county. That's where Elizabeth Doles home town of Salisbury is. A good friend of mine lives there.

That's why we're called the United States, not the Fifty But Separate States. Our United States are governed by a singular federal constitution. Each state is governed by a state constitution. If that state passes a law that is later deemed unconstitutional under the US Constitution, they may no longer enforce such law.

What you're talking about is nullification, a pipe dream of idiots like you that the SCOTUS has rejected, citing Supremacy Clause of the Constitution and Article III of the Constitution.

May I suggest moving to North Korea once it's a hole in the ground? You can set up your own little government any way you want.

Good thing NC isn't Congress, then - which is the whole whole point of the Establishment Clause. MA and CT could establish Congregationalism, PA and RI could guarantee religious freedom across the board, and people could live free provided the Federal government didn't act with a respect to an establishment of religion.

You mean like adhering to the 1st, which allows states, but not Congress to pass laws respecting an establishment of religion. It's not the Establishment Clause which is stopping NC or any other state in 2013 - it's the possibility that it could be incorporated through the 14th Amendment, and we'll need a SCOTUS ruling for that one.

That's the stupidest thing I ever heard. You'd turn the entire Constitution into a house of cards that would collapse the first time some anal retentive type doesn't get their way.
 
That was deliberately how it was set up. MA and CT had established Congregationalism; NH, NY, NJ, DE, MD, VA, NC, SC and GA had established the Christian religion. This left PA and RI without any formalized establishment. The 1st Amendment was only going to state "...pass no law establishing a national religion..." but at the time no one foresaw the Barron v Baltimore ruling, and thought that this would not keep Congress out of state level religious affairs, so they substituted "respecting an establishment of religion."
