this is not necessarily correct. if a state constitution provides greater protection of a right or a stricter prohibition of law, then the courts will generally side with the state.

most Libertarians believe it's a state issue and should be decided state per state.

Have you read your platform lately? Everything in it is about individual rights and disdain for the state.

I never once said you weren't a Libertarian, just that you are not an equal-opportunity critic. And your comment about "more liberals jacking around..." is ludicrous when one looks at the facts.
 
Try reading Mutt. It is ABORTION coverage. Period. Not specifically rape. It is if you want abortion coverage, you can choose to add it. But no one is forced to have coverage which in essence shares the costs of killing kids... some of us find that abhorrent.
Again, that's a specious argument. No one is forced to carry insurance for irresponsible behavior, like breaking a leg while skiing, some of us find that abhorrent.

it would require the same process only in reverse to repeal it.

No, that is simply the line of crap the left is trying to feed everyone. It is about ABORTION coverage. Period. Calling it 'rape insurance' is simply the way the left will sensationalize this and create a straw man to demonize the initiative.

So enough of the victim card. It is about whether or not a person should be FORCED to have abortion coverage. This initiative says NO ONE can be FORCED to have abortion coverage, but people CAN CHOOSE to have abortion coverage if they WANT IT.
 
Well as my thread title and initial comments state, it's about a minority group pushing this into law.

Yes, I saw that, but again, I am not up to speed on how Michigan law works. Though if it is somehow a 'law' created by getting signatures, I do not approve of the method in which this became a 'law'. Again, I was speaking to the CONTENT, not the method. I do disagree with the method if it is indeed a law now based on sigs of a tiny minority of voters.

I can't speak for medical related issues at this point, but I'm aware of some cases where the USSC denied QI to some cops for violating a fourth amendment right of unreasonable search and seizure based upon the wordiing of the state's 4th Amendment while the cops tried to argue the US 4th Amendment. that's just one of a few i've researched over the last year or so.

yes, I know this. It also happens to rely a great deal on each STATE constitution and what powers that the state has conferred upon them by the people. Thus, it is up to the states.

i thought that we live in a democratic republic where whosoever controls the house, senate and presidency makes the laws and then scotus gets a shot at them if a suit is brought through the courts
