You can absolutely publicly say you are going to kill someone. If you do not kill them, it is not murder. It could in that case be perceived as assault, but not murder.
Talking about firing someone with your advisers does not have a corresponding other violation as the above does.

That is the point moron. It could be construed as assault IF the person in question was present when it was said. If Joe and Bob are in a room together and Joe tells Bob "I want to kill Frank"... if Frank isn't there it isn't likely to even be considered assault. Thus, if Joe doesn't kill Frank, then there isn't a crime. It is just talk.
In the case of firing someone, If Trump tells McGahn to get Mueller fired, that is not obstruction. It is talk... unless action is taken to follow through with the talk. There is no other charge that applies.
