Washington (CNN)A federal judge on Tuesday blocked a Missouri law banning abortions after eight weeks from going into effect.

"The various sections specifying prohibitions on abortions at various weeks prior to viability cannot be allowed to go into effect on August 28, as scheduled," writes Judge Howard Sachs in an 11-page opinion.
"However formulated, the legislation on its face conflicts with the Supreme Court ruling that neither legislative or judicial limits on abortion can be measured by specified weeks or development of a fetus; instead, 'viability' is the sole test for a State's authority to prohibit abortions where there is no maternal health issue," Sachs wrote.

Tuesday's ruling comes after two other federal judges blocked similar abortion restrictions in Arkansas and Ohio earlier this summer, as the slew of state laws looking to challenge Roe v. Wade, the 1973 landmark ruling legalizing abortion nationwide, make their way through the courts.

The Missouri law in question would penalize medical professionals who perform abortions after eight weeks into a pregnancy -- before many women know that they are pregnant, and well before the 24-week viability standard established by Roe -- with up to 15 years in prison. The law does not include exceptions for instances of rape or incest, only for instances of "medical emergency," such to prevent a pregnant woman's death or "substantial and irreversible physical impairment."

Planned Parenthood, the American Civil Liberties Union and Paul, Weiss -- the law firm that argued in support of legalizing same-sex marriage in a landmark Supreme Court case -- filed the case last month.

The law would ban abortion outright should the Supreme Court overturn Roe. It also includes bans on abortion at 14, 18 and 20 weeks, which could go into effect if a court finds the eight-week ban invalid.

This is simply another example of the federal judiciary overstepping their Article III jurisdiction.

Under the US Constitution, States have the power to make their own laws regarding abortion. Legislating abortion is not a power of Congress nor of the federal judiciary, nor does the federal judiciary have the power to interpret the US Constitution.

MIAMI BEACH, Fla. — A woman was arrested Saturday morning in Florida after allegedly stomping on a sea turtle nest and stabbing it with a wooden stake, according to WPLG.

The Miama Beach Police confirmed none of the eggs were harmed.

Yaqun Lu, 41, who has a permanent address in Michigan, was charged with marine turtle or egg molestation/harassment, according to Miami-Dade County jail records.

Two Florida men were sentenced to prison after officials say they stole hundreds of sea turtle eggs from a St. Lucie County beach last year.

Carl L. Cobb, 60, and Raymond Saunders, 50, both of Riviera Beach, were convicted of transporting sea turtle eggs for the purpose of sale. Saunders was convicted of one count while Cobb was convicted of two counts, according to the U.S. Attorney’s Office for the Southern District of Florida.

Court records indicate a concerned citizen reported to the Florida Fish and Wildlife Conservation Commission that a man was disturbing sea turtle nests on North Hutchinson Island on May 5, 2017.

An investigation found more than 200 eggs were missing from two sea turtle nests, and that Cobb was responsible, according to the U.S. Attorney’s Office.

Officials spotted Cobb and Saunders take another 469 eggs from nests on the same island on May 24. The men were arrested while they were taking the eggs to Palm Beach County, according to the U.S. Attorney’s Office.

Marine biologists relocated the eggs in hopes they would yield some hatchlings.

Cobb and Saunders were each sentenced to seven months in prison to be followed by two years of supervised release and ordered to pay $227 in restitution to the State of Florida, the U.S. Attorney’s Office announced Wednesday.

It’s estimated tens of thousands of sea turtle eggs are stolen a year, due to a black market for the eggs in South Florida that can fetch sellers $3 to $5 an egg, wildlife officials told the Sun Sentinel. In some cultures, sea turtle eggs are considered a delicacy, or can be used for jewelry or medicines.

There are many ways you can make a difference for Florida’s sea turtles:

It’s a sea turtle night, turn off the light – After sundown, turn off any lights not necessary for human safety. Use long wavelength amber LED lamps for lights that must stay lit and shield lights, so they are not visible from the beach. Remember to close shades or curtains.

No flash photos, please – On the beach at night, don’t take flash photos or use bright cellphones or flashlights. This can cause turtles to become disoriented and crawl away from the ocean, putting them at risk.

Sea turtles are protected and must be respected – Stay back and give sea turtles space if you see one on the beach at night. Don’t touch a nesting turtle because it may leave the beach without nesting if disturbed. Remember, it is illegal to harm or disturb nesting sea turtles, their nests, eggs or hatchlings.

Clear the way at the end of the day – Beach furniture, canopies, boats and toys left behind on the sand can become obstacles that block nesting and hatchling turtles. Fill in any holes dug in the sand.

The State laws are not unconstitutional... The FEDERAL laws are unconstitutional... The federal judiciary interpreting the Constitution is also unconstitutional.

The "pro-life" narrative is largely articulated by the Christian right, and there are important differences between how Judaism and Christianity view the span of time between conception and birth.

Jewish law does not consider the fetus to be a being with a soul until it is born. It does not have personhood. Furthermore, before 40 days, some poskim, or deciders of Jewish law, have a low bar for allowing an abortion.

The Talmud, in Yevamos 69b, cites the view of Rav Hisda that “until forty days from conception the fetus is merely water. It is not yet considered a living being.”

If there is a threat to a woman’s life, the safety of the mother takes precedence over continuing the pregnancy at any stage. Many sources illustrate this graphically and rather unambiguously, and all modern poskim, or religious decisors, agree on this. In fact, in certain circumstances, a fetus that endangers the life of the mother is legally considered a “murderer” in active pursuit.

It's a human issue, not gender. It's an issue of the parents.

placing their bodies upon that developing life and defend its survival against
outside predators who would seek to destroy it before it is born and
continue that defense and protection after birth.

The right to freedom in personal healthcare decisions supersedes the right of a zygote to continue developing in a body.
